Fallout 4’s parent company, Zenimax is being sued by ‘The Wanderer’ songwriter for ‘morally indefensible’ ads

Fallout 4 is in the news again, but not for a reason it was probably hoping for. Dion DiMucci, the singer/songwriter behind "The Wanderer" song, is suing Zenimax, Bethesda Softworks' parent company over the ads that used the song such as the one embedded above.

DiMucci alleges that the commercials were "objectionable because they featured repeated homicides in a dark, dystopian landscape, where violence is glorified as sport. The killings and physical violence were not to protect innocent life, but instead were repugnant and morally indefensible images designed to appeal to young consumers."

Apparently, part of the agreement was for DiMucci to approve the use of his song provided certain terms were met. The lawsuit alleges that Zenimax failed to allow DiMucci the opportunity to request scripting changes for said conditions to be satisfied.

The lawsuit also states that DiMucci was unable to adequately "safeguard himself against the potential loss of goodwill from being associated with the immoral images in Defendant's scripts."

It's unclear what "goodwill" DiMucci has lost in the two years since Bethesda was advertising the game, but the 77-year old artist is obviously intent on moving forward and is seeking damages "in excess of $1 million." Given the $500 million that Zenimax recently pulled in from their lawsuit against Oculus, they can probably afford it.
